Original Q&A · Full displayed answer

The whole answer distinguishes investment for the orphan’s benefit from use for the guardian’s own benefit. Its narrowly conditioned safeguarding-loan case requires fear of loss or theft, no trustworthy alternative, a solvent guardian and no risk to the orphan’s money. Preserving the principal alone is not stated as general permission.

Original question

If a man looks after an orphan who owns money and is responsible for the orphan’s affairs, may he use that money, with the understanding that the orphan’s capital is preserved and will be returned to him?

Answer

Allah, exalted is He, has commanded that the affairs of orphans be improved and forbidden approaching their property except in the best way. He says, “They ask you about orphans. Say: improving their affairs is best. If you mix your affairs with theirs, they are your brothers. Allah knows the one who causes corruption from the one who improves matters” [al-Baqarah 2:220]. He also says, “Do not approach an orphan’s property except in the best way, until he reaches maturity” [al-Anam 6:152].

The orphan’s guardian must act in accordance with these two verses: improving the orphan’s finances and striving to develop, increase and preserve them, either by trading with the money or entrusting it to a trustworthy person who trades with it for an agreed share of the profit, such as half or a similar share, according to the customary practice where the transaction takes place. If that person gives all the profit to the orphan voluntarily, that is better and more virtuous. As for using the orphan’s money for the guardian’s own benefit, meeting his needs, expanding his own business or similar purposes, it appears that this is not permissible. It does not improve the orphan’s affairs and is not approaching the property in the best way.

If, however, he spends the money with the intention of borrowing it in order to safeguard it for the orphan—because he fears that leaving it where it is would expose it to loss, theft or similar harm, and he cannot find a trustworthy person to manage the orphan’s money—then, in those circumstances, this counts as improving matters and preserving the orphan’s property, provided that the guardian is solvent and the orphan’s money faces no risk while remaining a debt he owes.

In conclusion, the orphan’s guardian must act for the orphan’s benefit. Allah, exalted is He, knows the one who causes corruption from the one who improves matters, and He recompenses everyone for their deeds: good for good and evil for evil.

We ask Him to grant us and you success in what pleases Him.
