Original question
In his final question, Abu Muawiyah from Amman, Jordan, says: Some mosques lend books on condition that anyone who returns them after the specified period pays a fixed charge for each day of delay. The money is spent on the mosque or for its benefit. Is this permissible, esteemed Shaykh?
Answer
Yes, because this falls under rental. If he is late, his continued use is for a fee: a fee for benefiting from the book beyond the specified period. I know of no objection to this, because it encourages people to abide by conditions, fulfil them, and not be careless about keeping books with the borrower. If five or six days are specified, and he is told, 'Beyond that, you must pay such-and-such for delaying the book,' there is no harm in it, Allah willing, because it serves a considerable benefit. Yes.
Presenter: May Allah reward you with good.
