Original question
He was asked about a woman who had performed Hajj and intended to perform Hajj for a deceased woman for payment: may she do so?
Answer
She may perform Hajj for the deceased with money received by way of acting as a representative, by agreement. As for doing so under a hiring contract, scholars have two views, both reported from Aḥmad.
The first permits it, and this is al-Shāfiʿī's position.
The second does not permit it, and this is Abū Ḥanīfah's position. Furthermore, if this woman performing Hajj for the deceased intends the pilgrimage itself or to benefit the deceased, she has reward and recompense for that. If her only purpose is to take the fee, she has no share in the Hereafter from it.
