Original question
A man says: I am an employee in Makkah. When pilgrims come to me wanting me to rent a house for them, I agree with its owner that he will rent it to them for, say, two thousand, with three hundred riyals of that for me. Is this a bribe?
Answer
He must inform them when he and the owner have made that agreement. It is not permissible unless he informs them, because this is of the nature of bribery: he tells them it costs two thousand, whereas it is not two thousand but one thousand seven hundred. This is not permissible; it is of the nature of bribery. If he wants what is lawful, he should tell them: ‘I have agreed with him on two thousand, with three hundred for me if you permit that; otherwise, he is only to receive one thousand seven hundred. He agreed to the three hundred for me if you allow it, and otherwise I will forgo it,’ or words to that effect. That is, he must explain it to them; otherwise it is a breach of trust.
