Original question

A letter has reached the programme from Sudan, sent by your brother Muḥammad ʿUmar Ibrāhīm of Kassala. He asks: Some scholars hold that it is impermissible to declare the people of the qiblah, and anyone who says “There is no deity worthy of worship except Allah,” to be unbelievers. But does this include everyone who says it while holding erroneous beliefs involving associating others with Allah—by supplicating to others or directing acts of worship to others? Are they included among those whom the scholars say must not be declared unbelievers? Please clarify; may Allah reward you with good.

Answer

Yes. Ahl al-Sunnah—may Allah have mercy on them—say that a Muslim does not become an unbeliever through a sin. They mean sins below the level of shirk and unbelief, such as unlawful sexual intercourse, theft, disobedience to both parents or one of them, drinking intoxicants, and the like. If a Muslim commits one of these, he does not become an unbeliever guilty of major unbelief. Rather, he is sinful and defiantly disobedient. He does not become an unbeliever through this so long as he remains a believing worshipper of Allah alone and has only done it in obedience to his desires, without considering lawful what Allah has forbidden, such as intoxication, usury and the like. According to Ahl al-Sunnah, he is sinful, defiantly disobedient and weak in faith; he is not an unbeliever.

However, scholars differed about abandoning prayer out of laziness: is it included in this category, or is it a form of apostasy? The scholars have two views. The correct view is that it is one of the things that nullify Islam and one of the acts of apostasy, even if the person does not deny that prayer is obligatory. Prayer is the pillar of Islam and its greatest pillar after the two testimonies of faith. Evidence concerning its great importance and establishing that abandoning it is major unbelief has been reported to an extent not found concerning the other subsidiary duties of Islam.

Likewise, every act or statement that entails disparaging Islam, attacking Islam, mocking Islam, or denying what Islam has brought, and other such prohibited conduct, constitutes apostasy from Islam. For example, if someone mocks prayer, fasting, Hajj, the reports concerning the Day of Resurrection, or other matters of religion, his unbelief is major unbelief. Allah, glorified is He, says: “Say: Was it Allah, His verses and His Messenger that you were mocking? Make no excuses; you have disbelieved after your belief” [al-Tawbah 9:65–66].

Similarly, reviling the religion is major unbelief. Whoever reviles Islam, prayer, or the Messenger—peace and blessings be upon him—commits major unbelief. We seek refuge in Allah from that.

Likewise, whoever seeks rescue from the dead or idols, calls upon them to remove harm or bring benefit, or asks them for aid—“Aid, aid, my master so-and-so”—or asks this of idols, trees or jinn, commits major unbelief. This contradicts “There is no deity worthy of worship except Allah.” A person who says these words must therefore not contradict them through his deeds or statements, and must believe in what they signify: worshipping Allah alone and that He, glorified and exalted is He, is the One entitled to worship. If he says them without believing their meaning or acting in accordance with their meaning, he becomes an unbeliever, like the hypocrites who say these words yet are in the lowest depth of the Fire, because they only uttered them with their tongues.

Likewise, many apostates, when claiming affiliation with Islam, say “There is no deity worthy of worship except Allah,” yet engage in statements and actions opposed to it. Their claim to Islam and their utterance of these words do not benefit them while they commit what contradicts them, such as slaughtering for others besides Allah—for jinn—or supplicating to others besides Allah, such as the dead or idols and the like, or seeking rescue from others besides Allah during hardships, or similar acts of worship that they direct to others besides Allah. Through that a person commits major shirk, and must hasten to repent before dying in that state. Yes.
