Original question
About people who hear the call but do not respond: some pray at home; others are not seen praying by the questioner or by a number of people, who do not see them at prayer. Their conduct concerning prayer and other matters has not pleased Allah or His Messenger. May someone who sees a person in this condition turn away from him, or greet him? Give us an answer, and may you be rewarded.
Also, may a man serve as imam in a mosque in which only two or three people pray on some days, leading them in hope of Allah’s reward? If he leads there for a fee, may he seek to pray elsewhere solely for the greater merit of congregational prayer? Give us an answer; may Allah have mercy on you.
Answer
Congregational prayers held in the mosques are among the visible rites of Islam and its guiding practice. In the Sahih collection, Ibn Masud said: “These five prayers, in the mosque where prayer is established, are among the practices of guidance. Allah prescribed the practices of guidance for your Prophet. If you prayed in your homes as this man who stays behind prays in his home, you would abandon your Prophet’s practice; and if you abandoned your Prophet’s practice, you would go astray. Only a man known for hypocrisy would stay away from them. A man would be brought, supported between two others, until he was placed in the row.”
In the Sahih collection, the Prophet ﷺ said: “I have considered ordering that the prayer be established, then going with men carrying bundles of firewood to people who do not attend the prayer and burning their houses over them.” In Sahih Muslim, Abu Hurayrah said that a blind man came to the Prophet ﷺ and said, “Messenger of Allah, I have no guide to lead me to the mosque.” He asked for permission to pray at home, and the Prophet granted it. When the man turned away, he called him back and asked, “Do you hear the call to prayer?” He answered, “Yes.” He said, “Respond.” In a version in the Sunan collections, he asked, “Do you hear the call?” The man answered, “Yes.” He said, “I find no concession for you.”
In the Sunan collections, Ibn Abbas narrated that Allah’s Messenger ﷺ said: “If someone hears the call and no excuse prevents him from responding”—they asked, “What is an excuse?” and he replied, “Fear or illness”—“the prayer he offers is not accepted from him.” Abu Dawud narrated it.
Muslims agree that congregational prayer is a strongly confirmed matter in the religion. Most of the early scholars and the imams of hadith, such as Ahmad, Ishaq and others, as well as a group of al-Shafii’s followers and others, regarded it as an individual obligation. Other groups among al-Shafii’s followers and elsewhere regarded it as a collective obligation; this is the preferred position among al-Shafii’s followers.
A man who persists in abandoning congregational prayer is a man of bad conduct: his conduct is to be condemned and he is to be restrained from it. Indeed, he is to be punished for it and his testimony rejected, even according to the view that it is a strongly confirmed Sunnah. Someone known for sinfulness who neglects prayer falls under Allah’s words: “Then successors came after them who neglected prayer and followed desires; they will meet ruin.” He must be disciplined in a way that calls him to abandon prohibited acts and perform obligatory duties.
If a man is the regular imam of a mosque and the congregation would not be held without him, his prayer there is better than praying elsewhere, even if the other congregation is larger.
Someone known for openly abandoning obligatory duties or committing prohibited acts deserves to be shunned, and greetings are withheld as a disciplinary measure until he repents. Allah, exalted is He, knows best.
