Original question
She asks: Is the marriage gift (mahr) one of the pillars of marriage? What is the evidence? May Allah reward you with good.
Answer
The mahr is not one of its pillars or conditions, but it is nevertheless due. When Allah mentions marriage, He says: “Lawful to you are those beyond these, that you seek them with your wealth” [al-Nisāʾ 4:24]. If someone marries a woman without specifying a mahr, she is entitled to a mahr comparable to that of women like her, and the marriage is valid. If her guardian says to the husband, “I give her to you in marriage,” while she consents, and the husband says, “I accept,” in the presence of two witnesses, with no impediments, the marriage is valid. This applies if the woman has no impediment: she is not forbidden to the husband, not in iḥrām, not in a waiting period, and she consents; her guardian gives her in marriage, she agrees, and the husband accepts before two witnesses. The marriage is valid even if no mahr is named, but she is entitled to a comparable mahr. The Prophet ﷺ ruled this in the report of Maʿqil ibn Sinān al-Ashjaʿī: a man married a woman without naming a mahr and died, and the Prophet ﷺ said: “She is entitled to the mahr of women like her, without reduction or excess; she must observe the waiting period, and she inherits.”
The point is that this is the ruling for someone who marries without naming a mahr: she is entitled to a comparable mahr, whether he is alive or dead. If he dies, it is given from his estate. If he is alive, he must give her the mahr after consummation or being alone with her in seclusion—after intercourse or seclusion.
But if he contracts the marriage and then divorces her [before that], she is entitled to a parting gift. He gives her whatever Allah makes possible, clothing or money. Allah, glorified is He, says: “O you who believe, when you marry believing women and then divorce them before touching them, you have no waiting period to count for them. So provide for them and release them graciously” [al-Aḥzāb 33:49]. He says: “There is no blame upon you if you divorce women before touching them or assigning them a marriage gift. Provide for them—the wealthy according to his means and the constrained according to his means—a reasonable provision, a duty upon those who do good” [al-Baqarah 2:236]. She is not entitled to a comparable mahr in this case, but he gives her a parting gift, the wealthy according to his means and the constrained according to his means. A wealthy man may give an enslaved woman, a sum equal to a comparable mahr, or less, according to what is feasible. A man with limited means may give even a little, even clothing. It is reported from Ibn ʿAbbās—may Allah Most High be pleased with them both—that “the highest parting gift is an enslaved woman, and the least is clothing.”
The point is that a wealthy man gives a better parting gift than a man with limited means: something of substantial value, such as an enslaved woman whom he gives her, or a large sum approaching the mahr or half the mahr. He gives something greater than a poor man gives. A poor man gives according to his ability: suitable clothing within his means or money. Allah, majestic and exalted, left this general and did not specify a fixed amount, glorified and exalted is He. Yes.
