Original question
A questioner from Baljurashi in Saudi Arabia asks: May I pay a bribe to an employee or official who decides cases, such as a judge or the head of a committee inspecting my land, if my right cannot be established without it? If I do not pay, my right will be lost; if I pay, I obtain my right without wronging anyone else. Is this permissible? How do we reconcile it with the Messenger's ﷺ statement: “Allah curses the giver, receiver and intermediary of a bribe”?
Answer
It is impermissible to pay a bribe to any official, whether a judge, ruler or committee deciding between people. There is no doubt that this is prohibited and among the major sins, because of the hadith mentioned and because it leads to injustice and the loss of the rights of those who do not pay bribes.
