Original question

Explain the wording of the marriage contract to us in detail. People here call it “al-Fātiḥah” and know nothing about it. May Allah reward you with good.

Answer

The marriage contract is for the guardian—her father, brother or nearest male agnatic relative, in the order of father, son, full brother, paternal half-brother, and so on—to say to the husband: “I give you my daughter in marriage,” if she is his daughter; or his sister if she is his sister; or his mother if she is his mother. He says, “I give you so-and-so, my daughter, mother or sister, in marriage,” and the husband says, “I accept this marriage.” This is the form of the contract. Saying “I marry her to you,” “I give her to you in marriage,” or “I grant her to you in marriage” suffices, even…

What matters in the contract is the meaning. The guardian may say the equivalent in any language they understand, and the husband says, “I accept this marriage and consent to it.” When he says that, the contract is concluded, provided both the woman and the man are free of impediments. If there is an impediment, such as the woman or man being in iḥrām, marriage is not valid during iḥrām. If she is still in the waiting period following divorce or her husband's death, the marriage is not valid. Nor is it valid if the man is an unbeliever and she is Muslim. The conditions must be fulfilled and impediments absent. When they are, the guardian says, “I give you my daughter, sister, mother,” or the like, “in marriage,” and the husband says, “I accept,” in the presence of two upright witnesses to the contract. Four people attend the contract: the husband, guardian and two witnesses. It is preferable to precede it with the marriage sermon: “All praise belongs to Allah. We praise Him, seek His help and ask His forgiveness. We seek refuge in Allah from the evils of ourselves and our bad deeds. Whoever Allah guides, none can misguide; whoever He leaves astray, none can guide. I testify that there is no deity worthy of worship except Allah alone, with no partner, and that Muḥammad is His servant and Messenger.” Then he recites: “O you who believe, fear Allah as He should be feared, and do not die except as Muslims” [Āl ʿImrān 3:102]; “O mankind, fear your Lord, who created you from a single soul and from it created its mate, and from the two spread many men and women. Fear Allah, by whom you ask one another, and honour the ties of kinship. Indeed, Allah is ever Watchful over you” [al-Nisāʾ 4:1]; and: “O you who believe, fear Allah and speak upright words. He will rectify your deeds and forgive your sins. Whoever obeys Allah and His Messenger has achieved a tremendous success” [al-Aḥzāb 33:70–71]. After this sermon, the guardian says, “I give her to you in marriage,” and the husband says, “I accept.” This sermon is a recommended Sunnah. The guardian, husband, one of the witnesses or another attendee may recite it, as may the marriage officiant or judge before whom they marry. If one of those present—the husband, guardian, officiant or a witness—recites it, the purpose is fulfilled. It is called the sermon of need, but it is not a condition. If the guardian says, “I give her to you in marriage,” and the husband says, “I accept,” without the sermon, there is no harm. The marriage is valid if the two witnesses are present, the conditions fulfilled and the impediments absent, praise be to Allah. But they have left what is preferable: concluding the contract after the sermon you have heard.

Yes.
