Original question
In the story of ʿAbd al-Raḥmān ibn ʿAwf, you mention that his brother said, “Look at one of my wives.” Is it lawful for a suitor to look at a woman?
Answer
Yes. The Prophet ﷺ instructed the suitor to look. He said: “When one of you proposes to a woman, if he can see what would encourage him to marry her, let him do so, for that is more likely to bring harmony between you.” There is no harm in looking at the prospective bride, without being alone together in seclusion.
A man came and mentioned a woman he wished to marry, or had contracted marriage with. He asked him, “Have you looked at her?” The man said, “No.” He said, “Go and look at her.” Muslim narrated it in his Ṣaḥīḥ. There is no harm in this; indeed, it is among the means of harmony between them, bringing them together and establishing a sound marriage, if it is feasible and the family allows it without seclusion, with her maḥram, her mother or another person whose presence removes seclusion.
Jābir ibn ʿAbd Allāh al-Anṣārī—may Allah be pleased with him—mentioned that he sought to marry a woman and wanted to see her. He said that he moved among the palm trees while she was among them in the Ansar's plantations, hiding behind one palm after another until he saw something that pleased him, and then proposed to her.
The point is that if he can see her with permission and with her knowledge, there is no harm. If that is not possible and he sees her without her knowledge, through an opening, from behind palm trees or by some other means involving nothing prohibited in the Sharia and no seclusion, there is no harm.
Question: Do the family incur sin if they do not allow the suitor to see her?
Answer: Apparently they do not incur sin, but it is better and preferable to allow him, because this is among the means of harmony and bringing them together. The Prophet, peace and blessings be upon him, instructed it, saying, “Go and look at her.” His instruction to look indicates that it is recommended for them to enable him to do so. Since the Prophet instructed it, enabling the man he instructed to look is preferable.
But some people's custom is not to do this, and they find it difficult. Some say, “I fear that he will see her, not like her, and then talk among people, putting others off her afterwards.” They have reasons for their interpretation of the matter.
