Original question

A man died leaving wealth and orphans. Is zakah due on this wealth? If so, who pays it?

Answer

Zakah is obligatory on orphans’ money, goods prepared for trade, grazing livestock, and the grains and fruits on which zakah is due. The orphans’ guardian must pay it at the proper time. If their deceased father did not leave them a guardian, the matter must be referred to the court so that it appoints someone to oversee their affairs and property. In doing this, the guardian must fear Allah and act in the interests of the orphans and their wealth. Allah, Glorified is He, says: “They ask you about orphans. Say: Putting their affairs right is better” [al-Baqarah 2:220]. He also says: “Do not approach the orphan’s property except in the best manner, until he reaches maturity” [al-Anʿām 6:152]. There are many verses conveying this meaning.

The lunar year for their wealth is counted from the time their father died, because it became their property upon his death. Allah is the One who grants success.
